According The Real Estate Service Act of the Philippines or R.A. 9646, they are defined as:
Real Estate Broker – a duly registered and licensed natural person who, for a professional fee, commission or other valuable consideration, acts as an agent of a party in a real estate transaction to offer, advertise, solicit, list, promote, mediate, negotiate or effect the meeting of the minds on the sale, purchase, exchange, mortgage, lease or joint venture, or other similar transactions on real estate or any interest therein.
Real Estate Salesperson – a duly accredited natural person who performs service for, and in behalf of a real estate broker who is registered and licensed by the Professional Regulatory Board of Real Estate Service for or in expectation of a share in the commission, professional fee, compensation or other valuable consideration.
Sometimes a real estate salesperson can be referred as a real estate agent.
In the Philippines, only a licensed real estate broker and his/her accredited real estate salesperson can legally practice the real estate service profession. It is clearly defined in Republic Act No. 9646 that a real estate sales professionals to be licensed by the Professional Regulation Commission (PRC), the government agency in charge of all professionals, so that they can control education and experience requirements and have a central authority to resolve consumer problems.
Therefore, it is strictly emphasized that any person involved with selling, advertising, transacting, promoting, offering, negotiating and doing any act that constitutes real estate service practice is a crime as defined by Republic Act No. 9646,
Brokers are generally required to have more education and experience than real estate salespersons or agents. The person you normally deal with is a real estate agent or salesperson. The salesperson/agent is accredited by the PRC under the broker’s license, but must work for a broker. All listings are placed in the broker’s name, not the salesperson’s.
A broker can deal directly with home buyers and sellers, or can have a staff of salespersons or agents working for him or her.
